Alaska HB141 In Committee

This bill requires public buildings in Alaska to include universal changing facilities when constructing new bathrooms or undergoing significant remodeling (estimated at $30,000 or more). Specifically, the building must either have at least one publicly available bathroom with a universal changing facility, or if bathrooms are gender-divided, include universal changing facilities in at least one men's and one women's bathroom. The bill defines a "universal changing facility" as a table or device suitable for changing a child's diaper or providing personal care for an adult. Buildings are exempt from this requirement if installing such a facility is impractical or would compromise disability access standards. The Department of Transportation and Public Facilities must maintain a public website listing the locations of these facilities and is tasked with establishing regulatory standards for them. Building owners or lessees must report the installation of such facilities to the department. The bill also allows for civil action with potential remedies including injunctive relief, actual damages, attorney fees, and costs. This legislation applies to state-owned or state-controlled buildings, public transportation facilities funded by public money, and aims to improve accessibility for parents, caregivers, and individuals requiring personal care assistance.

This bill requires the Department of Administrative and Financial Services, Bureau of General Services to ensure that public restrooms in state-owned buildings have diaper changing stations that are physically safe, sanitary, and appropriate. Specifically, the bill mandates that any public restroom in a new state building or in a remodeled portion of a state building must include a diaper changing station. If the only restroom with a diaper changing station is gender-restricted, another restroom must also have a station, which can be satisfied by providing a gender-neutral or family restroom. The bill defines a diaper changing station as a table or device suitable for changing diapers of children under 4 years old. There are exceptions to this requirement, such as when installing a station would be too costly, would conflict with historic preservation rules, or would violate building codes. The bill also allocates $15,000 in each of the fiscal years 2025-26 and 2026-27 to help fund the installation of these stations, with the bureau required to complete installation by January 1, 2029, or when funding allows. The goal is to provide equitable access to diaper changing facilities for all caregivers in state buildings open to the public.
