Since 2015, numerous states have begun to introduce legislation surrounding Adult Changing Stations. Some states have already enacted laws requiring these dedicated changing areas, along with specifications that include the installation of Electric Height Adjustable Adult Changing Tables in different areas across the country.
Whether a state or public establishment, an architect whose designs need to meet certain requirements or a caregiver anticipating dignified change for a client or loved one, it’s important to have the latest information in order to ensure local laws are being upheld. Requires a public entity that constructs or renovates a restroom in a public building to include at least one diaper changing station (changing station) that is capable of serving babies and adults and that is accessible to both men and women. Requires a public entity that constructs a new restroom that is accessible to the public in a public building, or that totally renovates an existing restroom that is accessible to men, women and the public in a public building to: a) include at least one changing station in at least one restroom in each building that: i. is accessible to both men and women; ii. is capable of serving both babies and adults; and iii. provides sufficient clear floor space to comply with the 2010 Americans with Disabilities Act (ADA) standards for accessible design; b) provide signage that indicates the changing station's location near the entrance to the changing station; and c) indicate the changing station's location in the building directory if such a directory exists. 2. Permits the responsible authority to grant an exemption from changing station requirements if any of the following applies to the construction of a changing station that serves both babies and adults: a) the installation would not be feasible; b) the installation would result in a failure to comply with ADA standards for access for persons with disabilities; c) the installation would threaten or destroy the historic significance of a historic property; or d) the building is not frequented by the public. 3. Applies changing station requirements to construction and renovation projects in which the design has been approved on and after January 1, 2020. 4. States that this legislation does not establish a private right of action. 5. Defines relevant terms. 6. Becomes effective on the general effective date. |

California | AB 662 | Enacted | The people of the state of California do enact as follows: SECTION 1. Section 19952.5 is added to the Health and Safety Code, to read: 19952.5. (a) A person, private firm, organization, or corporation that owns or manages a commercial place of public amusement shall install and maintain at least one adult changing station for persons with a physical disability that is accessible to both men and women when the facility is open to the public, if either of the following occur: (1) The commercial place of public amusement is newly constructed on or after January 1, 2020. (2) (A) When an existing commercial place of public amusement is renovated on or after January 1, 2025, and requires a permit or the estimated cost of the renovation is ten thousand dollars ($10,000) or more. (B) A commercial place of public amusement with an enclosed restroom facility or other similar private facility with an adult changing table in use before January 1, 2025, shall be deemed to comply with this paragraph. (b) A facility shall ensure that the entrance to each adult changing station has conspicuous signage indicating the location of the station, and, if the facility has a central directory, shall ensure that the central directory indicates the location of the adult changing station. (c) For purposes of this section, all of the following definitions shall apply: (1) “Commercial place of public amusement” means an auditorium, convention center, cultural complex, exhibition hall, permanent amusement park, sports arena, or theater or movie house for which the maximum occupancy is determined to be 2,500 or more people. “Commercial place of public amusement” does not include any public or private higher education facility or district agricultural association. (2) “Adult changing station” means an adult changing table placed within an enclosed restroom facility or other similar private facility that is for use by persons with physical disabilities who need help with diapering. (3) “Physical disability” means a mental or physical disability, as described in Section 12926 of the Government Code. |

Defines "State-owned building" as the State Capitol Building or a rest stop located on an interstate highway. |

Iowa | HF 2596 | Pending Review | For purposes of this section, “adult changing station” means a universally-accessible, height-adjustable adult changing table placed within an enclosed restroom facility or other similar facility that is for use by persons with disabilities who need assistance with diapering. 1) An adult changing station shall be installed and maintained at all of the following locations: (a) Any building or facility to which the public is invited or in which the public is permitted, on which construction will commence on or after January 1,2022. (b) Any building or facility to which the public is invited or in which the public is permitted, on which construction of renovations to the building or facility will commence on or after January 1,2025, and where such renovations will require a permit, certificate, authorization, or other required document or where the renovations will cost ten thousand dollars or more. (c) Any building or facility to which the public is invited or in which the public is permitted, with the capacity to serve one thousand five hundred or more persons in any one day, including but not limited to state buildings and facilities. (d) Shopping malls and retail stores with a floor space of forty thousand square feet or more. (e) Entertainment venues with a floor space of forty thousand square feet or more, including but not limited to theaters, concert halls, auditoriums, and other facilities primarily used for exhibiting motion pictures, stage performances, lectures, musical recitals, and other similar performances, bingo facilities, gambling structures, and indoor arenas including sports arenas. (f) Public transportation facilities under the authority of the state or its political subdivisions, including bus stations. (g) Galleries, libraries, museums, and tourist information centers. (h) Parks, playgrounds, recreational centers, zoos, and amusement or theme parks. (i) General aviation airports as defined in section 328.1. (j) Rest areas as defined in section 306C.10. (k) Public or nonpublic educational facilities, including but not limited to schools, colleges, and universities. (l) Hospitals as defined in section 135B.1. (m) A facility as defined in section 125.2. 2) Each location required to install and maintain an adult changing station, as provided for in subsection 2, shall ensure that the entrance to each adult changing station has conspicuous signage indicating the location of the adult changing station. 3) A person who violates this section shall be assessed a civil penalty by the department of human rights which is not to exceed two hundred fifty dollars. Moneys collected under this subsection shall be remitted to the treasurer of state for deposit in the general fund of the state. This bill takes effect January 1, 2021. The bill shall be known as Adalynn’s law. |

155:80 Universal Changing Station Required. – I. A person, private firm, organization, corporation, or state government that operates a public building or facility shall install and maintain at least one universal changing station in a family restroom facility for persons of either sex who have a physical disability. II. (a) The universal changing station shall measure at least 8 feet by 10 feet and per Americans with Disabilities Act governance and rules, adequate space for an electronic/full adult-sized wheelchair to maneuver; be equipped with a powered, height adjustable adult changing table, a waste receptacle, a toilet, a lavatory, a soap dispenser, and a paper towel dispenser; and comply with current Americans with Disabilities Act accessibility standards. (b) The powered, height adjustable adult changing table in the universal changing station shall: (1) Be able to lower to a height of no less than 8 inches and raise to height of no less than 34 inches. (2) Be at least 25 inches wide by 72 inches in length. (3) Support up to at least 350 pounds. (c) The entrance to each universal changing station in the family restroom facility shall have accessible signage indicating the location of the changing station, and, if the building or venue has a central directory, the owner shall ensure that the central directory indicates the location of the universal changing station. III. This subdivision shall apply to any public building or facility that is open to the public and is built on or after January 1, 2021 |

The act of November 10, 1999 (P.L.491, No.45), known as the Pennsylvania Construction Code Act, is amended by adding a section to read: 1) Changing stations in places of public accommodation. Installation and maintenance.--An individual, corporation, partnership, company, organization, association or other business entity that owns or manages a place of public accommodation shall install and maintain at least one adult changing station for persons with disabilities or special health care issues or the elderly. Each changing station shall be accessible to both men and women when the place of public accommodation is open to the public and any of the following conditions are met: (a) The place of public accommodation is constructed on or after the date which is two years after the effective date of this subsection. (b) Except as provided in subsection (b), when an alteration or addition is made on or after the date which is four years after the effective date of this subsection to a place of public accommodation which existed before the effective date of this subsection and: (i) The alteration or addition requires a permit; or (ii) The estimated cost of the alteration or addition is $10,000 or more. 2) A place of public accommodation shall ensure that: (a) the entrance to each adult changing station has conspicuous signage indicating the location of the adult changing station; and (b) if the place of public accommodation has a central directory, the central directory indicates the location of the adult changing station. |
